
The ways of the Sri Lankan justice system
The court hearing of the case against the Sri Lankan military for the murders of 17 Action Faim employees has been transferred from Trincomalee to Anuradhapuram. Observers of the Sri Lankan justice system should seriously explore the reasons for the transfer.
Tamils lost their faith in the Sri Lankan justice system through years of bitter experiences. International observers too have joined the Tamils recently in expressing lack of confidence in the Sri Lankan justice system. The latest comment was made by an official of the Action Faim itself. The transfer of the court hearing from Trincomalee to Anuradhapuram must be studied with this in mind. This is not the first time similar court cases were transferred. The Mayilanthai massacre hearing, one of the very few on going court cases against the Sri Lankan military, was transferred from Batticaloa to Pollanaruwa. What are noteworthy are that in these cases, the hearing started in the district where the incident occurred; where the families of victims live; where the witnesses to the incidents live; and where many Tamils live. The transferred districts, Anuradhapuram and Polonnaruwa, are Sinhala majority areas where Tamils giving evidence against the Sri Lankan military will feel very insecure. This should explain the motive behind the transfer. Can the international community do anything about it other than expressing lack of confidence?
