Norway writes Tamil National Leader and Sri Lankan President

“The Oslo talks planned to discuss the operations of the SLMM was called off after day one because too much emphasis was put on making the two parties sit across the table and less emphasis placed on discussing the key issues”, said LTTE Political Head S P Tamilselvan.

“Addressing this issue separately with the two sides is more productive and face to face talk is not a key requirement to achieve results”, he added.

It must be noted that the CFA and the mandate and role of the SLMM was negotiated by the Norwegian facilitators and signed in February 2002 without any direct talks between the two parties. Given the current dangerous situation in the Northeast, direct talk between the two parties is unproductive. Also, the GoSL delegation did not include any ministers or political representatives with powers to make decisions.

The GoSL delegation also refused a face to face meeting between the leader of its delegation, Palitha Kohona, Director General of the Government Peace Secretariat and his counterpart, S Puleedevan, Secretary General of LTTE Peace Secretariat. GoSL declined the offer and walked off from the talks.

LTTE wanted to raise the key issue of the inclusion of EU countries in the SLMM following the EU ban on the LTTE. LTTE welcomes EU statement that they will continue to dialogue with the LTTE. However, ceasefire monitoring requires absolute neutrality and the EU countries have compromised their neutrality by banning the LTTE.

Following the day-one talks and lack of progress, Norway has written to the Tamil National Leader and the Sri Lankan President requesting written answers to the following questions.

1. Will the parties stand committed to the Ceasefire Agreement (CFA) of 22 February 2002?

2. Do the parties want the continued existence and operation of the Sri Lanka Monitoring Mission as a mission coordinated, facilitated and led by the Royal Norwegian Government with diplomatic immunity to ensure its impartial operation?

3. Are the parties able to provide full security guarantees for all monitors, employees and physical assets of the SLMM in all situations, in accordance with CFA Article 3.9?

4. Will the parties accept amendments to CFA Article 3.5 in order to enable the continued functioning of the Sri Lanka Monitoring Mission at its current operational levels and with the necessary security guarantees?

5. In the event that amendments to Article 3.5 are made, will the parties provide full security guarantees for current SLMM personnel and assets during a six-month transition phase until an amended solution has been identified, decided and fully implemented?
